2. Information we collect
We collect information in the following categories:
Information you provide
- Account data: email address, name, and sign-in method when you create an account (including via Google or email magic link through Firebase Authentication).
- Workspace & product data: voice profiles, product facts, banned phrases, topic lists, batch job names, generation settings, and other content you submit to run the Service.
- Payment data: billing-related identifiers and transaction metadata. Payment card details are processed by Stripe; we do not store full card numbers on our servers.
- Lead & sample data: email and optional contact details when you request a free sample, use free tools, or otherwise submit a lead form.
- Support & communications: messages you send us and our replies.
Information collected automatically
- Device & usage data: IP address, browser type, operating system, pages viewed, referring URLs, and similar technical data.
- Security & abuse prevention: signals used for rate limiting, fraud prevention, and reCAPTCHA verification (via Google).
- Analytics (optional): if you accept our cookie banner, we use Firebase Analytics (Google Analytics 4) to measure site usage and conversion events such as sign-ups, tool use, and purchases. Analytics is not loaded if you decline.
- Cookies & local storage: essential cookies and browser storage for authentication, session management, security, and (with consent) analytics preferences.
Information from third parties
We may receive information from authentication providers (e.g., Google), payment processors (Stripe), and analytics or security vendors that help us operate the Service.
3. How we use information
We use information to:
- Provide, operate, maintain, and improve the Service;
- Create and manage accounts, workspaces, and credit balances;
- Process payments and fulfill purchases;
- Generate, store, and deliver content you request;
- Communicate with you about the Service, including transactional messages and (where permitted) product updates;
- Monitor, prevent, and address abuse, fraud, security incidents, and violations of our terms;
- Comply with legal obligations and enforce our rights; and
- Analyze aggregated or de-identified usage to improve the product (analytics only with consent where required).
4. AI processing & your content
To deliver the Service, we process content you submit (including topics, brand guidance, and workspace settings) through automated systems and third-party AI infrastructure (including Google Vertex AI). You retain ownership of content you submit, subject to the license below.
You grant TopicForge a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, and display your submitted content solely to provide, secure, and improve the Service and as otherwise described in this policy. You represent and warrant that you have all rights necessary to submit such content and that your use of the Service complies with applicable law.
AI-generated output may be inaccurate or incomplete. You are solely responsible for reviewing, editing, and publishing any output before use. TopicForge does not guarantee factual accuracy, legal compliance, or suitability of generated content for any purpose.
5. How we share information
We do not sell your personal information. We may share information with:
- Service providers that help us operate the Service (e.g., cloud hosting, authentication, payments, analytics, email, AI inference, security), under contractual obligations to protect data and use it only on our instructions;
- Professional advisors (lawyers, accountants, insurers) as needed;
- Business transfers in connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to this policy or notice to you;
- Legal & safety when we believe disclosure is required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of TopicForge, our users, or others.
6. Cookies & analytics choices
Essential cookies and storage are used to run the Service (sign-in, security, reCAPTCHA). Optional analytics cookies are used only if you click Accept on our cookie banner.
You can change your choice anytime using the link in the site footer. Your preference is stored locally as tf:cookieConsent.
Browser controls may also block cookies; blocking essential cookies may limit account features.
7. Data retention
We retain information for as long as needed to provide the Service, fulfill the purposes described in this policy, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods vary by data type. When you delete your account or request deletion, we will delete or de-identify personal information within a reasonable period, except where retention is required by law or permitted for backup, security, fraud prevention, or legitimate business records (e.g., payment and tax records).
8. Security
We use commercially reasonable administrative, technical, and organizational measures designed to protect information. However, no method of transmission or storage is completely secure. You use the Service at your own risk. You are responsible for safeguarding your account credentials and API keys.
9. International transfers
TopicForge is based in the United States. If you access the Service from outside the U.S., your information may be processed in the U.S. and other countries where we or our providers operate, which may have different data protection laws than your jurisdiction. By using the Service, you consent to such transfers to the extent permitted by applicable law.
10. Your rights & choices
Depending on where you live, you may have rights to access, correct, delete, or port personal information, or to object to or restrict certain processing. To exercise these rights, email [email protected]. We may need to verify your identity before responding.
California residents (CCPA/CPRA): We do not sell or share personal information for cross-context behavioral advertising. You may request access, deletion, or correction of personal information, and you will not receive discriminatory treatment for exercising privacy rights, subject to applicable law.
EEA/UK residents: Where GDPR applies, our legal bases may include contract performance, legitimate interests (e.g., security, product improvement), consent (e.g., analytics where required), and legal obligation. You may lodge a complaint with your local supervisory authority.
We may decline requests that are unfounded, excessive, or prohibited by law, or that would adversely affect the rights of others.
11. Children
The Service is not directed to children under 13 (or under 16 where applicable law requires). We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will take steps to delete it.
12. Third-party links & services
The Service may link to third-party sites or integrate third-party services (e.g., Google, Stripe). Their privacy practices are governed by their own policies. TopicForge is not responsible for third-party practices.
13. Changes to this policy
We may update this Privacy Policy from time to time. The effective date at the top will reflect the latest version. Material changes may be posted on the Service or communicated by reasonable means. Continued use after changes become effective constitutes acceptance of the updated policy, to the extent permitted by law.
14. Disclaimers & limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL INFORMATION HANDLING DESCRIBED HEREIN ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TOPICFORGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOPICFORGE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THIS POLICY OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO PRIVACY OR DATA HANDLING UNDER THIS POLICY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TOPICFORGE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
15. Indemnification
You agree to defend, indemnify, and hold harmless TopicForge and its officers, directors, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) content you submit; (c) your violation of this policy, applicable law, or third-party rights; or (d) your negligence or willful misconduct.
16. Governing law & disputes
This Privacy Policy is governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
Any dispute arising out of or relating to this policy or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in those courts, except where prohibited by applicable law.
